Welcome to ABA Job LLC (“the Platform,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of our website, job board, and related services (collectively, the “Services”). By using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.
Eligibility & Jurisdiction: The Services are intended for users located within the United States. By using the Platform, you represent that you are at least 18 years of age (or the legal age of majority in your jurisdiction) and that you are accessing the Services in compliance with applicable U.S. laws. Users outside the United States access the Platform at their own risk and are responsible for compliance with local laws.
Accounts & Registration: To post or apply for jobs, you may be required to create an account. You agree to: Provide accurate, complete, and current information. Maintain the confidentiality of your login credentials. Accept responsibility for all activity under your account.
We may suspend or terminate accounts that provide false information or misuse the Services.
User Content & License: Employers and job seekers may submit content such as resumes, job postings, company profiles, and other materials (“User Content”).
Ownership: You retain ownership of your User Content.
License Grant: By submitting User Content, you grant ABA Job LLC a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute it solely in connection with operating and promoting the Platform.
User Representations: You represent that you have the necessary rights to post your User Content and that it does not violate laws or third-party rights. We reserve the right to remove any User Content at our discretion.
Job Postings & Employer Responsibilities: Employers are solely responsible for: The accuracy and legality of job postings. Compliance with all labor, employment, and anti-discrimination laws. Ensuring postings are not misleading, fraudulent, or exploitative. We may remove job postings that violate these Terms without issuing a refund.
Job Seeker Responsibilities: Job seekers agree to: Provide truthful and accurate information in resumes, applications, and communications. Use the Platform for legitimate job search purposes only. Refrain from misrepresenting qualifications or credentials.
Prohibited Uses: You may not use the Platform to: Post or distribute spam, fraudulent, discriminatory, or unlawful content. Scrape, harvest, or misuse of personal data. Upload malicious code or disrupt platform operations. Harass, impersonate, or abuse others. Violation may result in account suspension or termination.
Service Availability & Modifications: We do not guarantee uninterrupted or error-free operation of the Platform. Access may be suspended due to maintenance, upgrades, or events beyond our control. We may change, suspend, or discontinue any Services at any time without liability.
Intellectual Property: All software, trademarks, design, and content on ABA Job LLC are owned by or licensed to us. Users may not reproduce, distribute, or create derivative works without prior written consent.
Paid Services & No Refund Policy: Employers may be charged fees for job postings, subscriptions, or premium features.
No Refund Policy: All payments made to ABA Job LLC are final and non-refundable, including posting fees, subscriptions, or upgrades. Refunds will not be issued for lack of applications, candidate responses, or hiring outcomes. Exceptions may only be granted where required by law.
Disclaimer of Responsibility: ABA Job LLC is not an employer, recruiter, or staffing agency. We do not guarantee employment, job seeker qualifications, or the accuracy of postings. All employment decisions are solely the responsibility of the employer and job seeker.
Privacy & Data Use: Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
Disclaimer of Warranties: The Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability: To the fullest extent permitted by law: We are not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid for Services in the twelve (12) months before the claim.
Indemnification: You agree to indemnify and hold harmless ABA Job LLC and its affiliates from any claims, damages, or losses arising from your use of the Services, job postings, or interactions with other users.
Governing Law & Dispute Resolution: These Terms are governed by the laws of New Jersey: You agree to resolve disputes through binding arbitration in New Jersey or an agreed upon thirdparty unless prohibited by law.
Informal Resolution: You must first attempt to resolve disputes directly with us. Class Action Waiver: You agree not to participate in class or collective action.
Termination: We may suspend or terminate accounts that violate these Terms or applicable law. Upon termination, your right to use the Services ends immediately.
Severability & Entire Agreement: If any provision of these Terms is found invalid, the remainder shall remain in effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and ABA Job LLC.
California Consumer Rights Notice: Under California Civil Code Section 1789.3, California users are entitled to the following specific consumer rights notice: If you have a complaint regarding the Services or wish to request further information, please contact us at [your contact email]. California Employment Compliance:
Employers using the Platform are solely responsible for ensuring that their job postings and hiring practices comply with applicable California labor, wage, and anti-discrimination laws. ABA Job LLC does not review postings for legal compliance and assumes no liability for violations by employers.
Modifications: We may update these Terms at any time. Updates will be posted with a new “Last Updated” date. Continued use of the Services after updates constitutes acceptance.
